Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and 1x Neon Esports Club ("we," "us," or "our") governing your use of the 1x Neon Esports Club mobile application (the "App").
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use this App. By using the App, you represent and warrant that:
- You meet the minimum age requirement
- You have the legal capacity to enter into these Terms
- You are not prohibited from using the App under any applicable law
- If you are using the App on behalf of an organization, you have authority to bind that organization to these Terms
Account Registration
Certain features of the App may require you to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
App Services
The 1x Neon Esports Club App provides the following services:
- Gaming Station Reservations: Book PC, console, and VR gaming stations at participating esports lounges
- Food & Beverage Ordering: Order snacks, drinks, and meals for pickup at participating venues
- Tournament Registration: Sign up for esports tournaments and community events
- QR Code Passes: Store and manage digital passes for reservations, orders, and events
- Loyalty Program: Earn XP and rewards for participation and purchases
Services are subject to availability and may vary by location. We reserve the right to modify, suspend, or discontinue any service at any time.
Reservations & Bookings
When making reservations through the App:
- Reservations are subject to availability and venue confirmation
- You agree to arrive on time for your reserved time slot
- Late arrivals may result in shortened session times or cancellation
- Cancellation policies are set by individual venues and may vary
- No-shows may result in account restrictions or penalties
Orders & Payments
For food, beverage, and service orders:
- All prices are displayed in the local currency and may include applicable taxes
- Payment is processed at the time of order or upon pickup, as specified
- We are not responsible for order fulfillment, which is handled by participating venues
- Refunds and exchanges are subject to venue policies
- You agree to pay all charges incurred under your account
User Conduct
You agree to use the App responsibly and in compliance with all applicable laws. You shall not:
- Use the App for any unlawful or unauthorized purpose
- Violate any local, state, national, or international law or regulation
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the App or servers
- Attempt to gain unauthorized access to any part of the App
- Use automated systems, bots, or scripts to access the App
- Transmit viruses, malware, or other harmful code
- Harass, abuse, or harm other users
- Submit false or misleading information
- Circumvent any security features of the App
Venue Rules & Conduct
When visiting participating esports lounges:
- You agree to comply with all venue rules and house policies
- You must follow instructions from venue staff
- Inappropriate behavior may result in removal and account suspension
- You are responsible for any damage to equipment caused by your actions
- Venue-specific age restrictions and policies apply
Intellectual Property
The App and its contents, including but not limited to text, graphics, logos, icons, images, software, and code, are the property of 1x Neon Esports Club or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute the App or its contents
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App for commercial purposes without authorization
- Create derivative works based on the App
User Content
You may submit content through the App, including but not limited to profile information, reviews, and feedback ("User Content"). By submitting User Content, you:
- Grant us a non-exclusive, royalty-free license to use, display, and distribute your User Content
- Represent that you have the right to submit such content
- Agree not to submit content that is illegal, offensive, or violates third-party rights
We reserve the right to remove any User Content that violates these Terms.
Third-Party Services
The App may integrate with or link to third-party services, websites, or applications. We are not responsible for:
- The content, accuracy, or practices of third-party services
- Any transactions between you and third parties
- Privacy practices of third-party services
- Availability or functionality of third-party services
Your use of third-party services is governed by their respective terms and policies.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY OF DATA TRANSMISSION
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1x Neon Esports Club SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Business interruption
- Personal injury or property damage
- Any damages arising from your use of the App
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless 1x Neon Esports Club, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Last updated" date
- Sending a notification through the App (for significant changes)
Your continued use of the App after changes constitute acceptance of the modified Terms.
Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:
- Your license to use the App ends immediately
- You must cease all use of the App
- Provisions that should survive termination will remain in effect
You may terminate your account at any time by contacting us or deleting the App.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1x Neon Esports Club operates, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Informal Resolution: Contact us first to attempt to resolve the dispute informally
- Mediation: If informal resolution fails, disputes may be submitted to mediation
- Arbitration/Litigation: Unresolved disputes may be submitted to binding arbitration or court proceedings as permitted by law
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1x Neon Esports Club regarding your use of the App and supersede all prior agreements and understandings.
